DW Building Services – Terms & Conditions of Service
DW Building Services provides professional building, landscaping, roofing, fencing, repointing, and property maintenance services. These Terms & Conditions outline the responsibilities of both DW Building Services and the Client.
By engaging DW Building Services’ services, you agree to these Terms & Conditions.
1. Service Provision
DW Building Services will carry out agreed works using appropriate skills, equipment, and safe working practices.
Services may be delivered onsite at the Client’s property or at another agreed location depending on the nature of the work.
2. Client Responsibilities
The Client is responsible for ensuring:
Safe and suitable access to the property and working areas
The work area is clear and accessible where reasonably possible
A safe working environment in compliance with health and safety regulations
Any required permissions, approvals, or neighbour access arrangements are obtained where necessary
Failure to meet these requirements may result in delays or additional charges.
3. Property & Existing Conditions
DW Building Services will take reasonable care during all work carried out.
However, the Client acknowledges that some work, particularly repairs, demolition, repointing, roofing, excavation, and renovation work, may uncover hidden defects or pre-existing issues that were not visible prior to work commencing.
Any additional work required as a result may be quoted separately.
4. Access & Facilities
The Client must provide reasonable access to the property, work areas, and where necessary, access to utilities such as electricity and water.
If access is restricted or delayed, additional charges may apply.
5. Quotations & Additional Work
All quotations are based on the information available at the time of quoting.
Any additional work requested by the Client or required due to unforeseen circumstances may be subject to additional charges. No additional work will be undertaken without discussion where reasonably possible.
6. Fees & Payment Terms
All fees are exclusive of VAT unless stated otherwise.
Payment terms will be confirmed on quotations or invoices provided by DW Building Services.
Late payments may be subject to interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
DW Building Services reserves the right to withhold completion certificates, waste transfer documentation, or further work until payment has been received in full.
7. Cancellations & Rescheduling
DW Building Services reserves the right to apply reasonable charges where work is cancelled at short notice, particularly where materials have been ordered or time has been allocated.
All cancellations should be made in writing where possible.
Rescheduling may be accommodated at DW Building Services’ discretion.
8. Liability
DW Building Services will take all reasonable care in the provision of its services.
However, DW Building Services shall not be liable for:
Indirect or consequential losses
Loss of business, revenue, or profits
Damage arising from pre-existing defects or structural issues not reasonably identifiable before work commenced
Total liability shall be limited to the value of the contracted services provided.
Nothing in these terms limits liability for death or personal injury caused by negligence.
9. Delays & Force Majeure
DW Building Services shall not be held responsible for delays or failure to perform services due to circumstances beyond reasonable control, including but not limited to:
Weather conditions
Supply chain or material shortages
Site access restrictions
Unexpected structural or property issues
Equipment failure or illness
10. Waste Removal
Where agreed as part of the quotation, DW Building Services can remove waste materials from site legally under the appropriate waste transfer arrangements.
Any waste removal included within quotations will be clearly stated.
11. Compliance & Standards
Work is carried out using appropriate equipment, materials, and safe working procedures in line with recognised industry standards where applicable.
12. Variation of Terms
These Terms & Conditions may only be varied by written agreement between DW Building Services and the Client.
